SmartSAT Terms of Service

1. Acceptance of these Terms

These Terms govern your use of SmartSAT ("SmartSAT", "we", "us"). By creating an account or using SmartSAT you agree to these Terms of Service, to our Privacy Policy and to our Disclaimer. If you do not agree, do not use the service.

2. Who may use SmartSAT

  • You must be at least 13 years old to hold an account.
  • If you are under 18, you may use SmartSAT only with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.
  • Schools and tutoring organisations may enrol students under a seat licence; the organisation is responsible for obtaining the required consents.

3. Your account

  • Provide accurate registration information and keep it up to date.
  • An account is personal to one student and may not be shared, sold or transferred.
  • You are responsible for keeping your password confidential and for activity that happens under your account. Tell us promptly if you believe it has been compromised.

4. The service

SmartSAT provides SAT practice exams, AI-generated practice variants of questions you got wrong, vocabulary training, progress analytics and score estimates, plus reports for the parents and teachers a student has linked to their account. Features change over time as the product develops.

5. Acceptable use

  • Do not use bots, scrapers or other automated tools against the service.
  • Do not attempt to extract, copy, republish or reverse engineer question content, nor to circumvent the measures that protect it.
  • Do not attempt to access data belonging to other users.
  • Do not submit unlawful, abusive or infringing content through feedback or chat.
  • Do not interfere with the security, integrity or availability of the service.

6. Intellectual property

  • The platform, question bank, explanations and teaching materials are owned by SmartSAT or its licensors. You receive a limited, personal, non-transferable, revocable licence to use them for your own exam preparation.
  • AI-generated practice variants are likewise the property of SmartSAT.
  • Your own answers, notes and training history remain yours. You grant us the licence needed to operate the service — to store this data, show it to you and to the parents and teachers you have linked, and to generate practice content and aggregated, de-identified statistics.

7. AI-generated content

Parts of SmartSAT are generated by large language models and may contain errors. They are study aids, not authoritative answers. Please read the Disclaimer — it forms part of these Terms.

8. Subscriptions, licence keys and payments

  • Prices, plan contents and billing periods are those shown at the time of purchase.
  • Payments are handled by third-party payment processors under their own terms.
  • Except where a refund is required by applicable law or has been agreed by us in writing, payments are final and non-refundable.
  • We may change prices and plans for future billing periods; changes never apply retroactively to a period you have already paid for.
  • If a price, plan or benefit is displayed incorrectly, we may correct it and are not obliged to honour the erroneous display.

9. Third-party services

SmartSAT relies on third-party infrastructure (hosting, database, email delivery, payment processing, AI model providers) and may link to third-party sites. We are not responsible for their content, availability or practices.

10. Suspension and termination

You may stop using SmartSAT and request deletion of your account at any time. We may suspend or terminate an account that breaches these Terms, or that we reasonably believe is being used to harm other users or the service. We may modify, suspend or discontinue any part of the service; where a change is material and we hold your email address, we will give notice in advance where reasonably practicable.

11. Disclaimers and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that the service will be uninterrupted or error-free, and we do not guarantee any particular SAT score or admissions outcome.

To the extent permitted by law, SmartSAT is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or opportunity. Our total liability arising out of or relating to the service is limited to the amount you paid us for the service in the twelve months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law.

12. Changes to these Terms

We may update these Terms. The current version is always published on this page with its effective date. Material changes will be announced by email or in-app notice where we hold the necessary contact details. Continuing to use SmartSAT after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator of SmartSAT is established, without regard to its conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction over disputes — except where mandatory consumer protection law in your country of residence gives you the right to bring proceedings locally.
